İstinaf "yeniden başlama" anlamını taşımaktadır. Bölge mahkemeleri yerel mahkemeden görülen hukuksuz bir yargılamayı tekrar etme yetkisine sahiptir. Bu yönden hukuk sistemimizde nitelikli sayılabilecek bir gelişmedir. Nitekim dosya yoğunluğuna cevap veremeyen personel sayısı nedeniyle uzun yargılama süreci vatandaşı tatmin etmemektedir. Geç gelen adalet gerçekten de adalet hissiyatını vermemektedir.
